** Important Medicaid Update on Tamper-Resistant Prescriptions **

Dated September 5, 2007

The Health and Human Services Commissioner (HHSC) is actively working with the federal agency, Centers for Medicare and Medicaid Services (CMS), to determine when and how to implement the tamper-resistant prescription requirement outlined in federal law recently passed by Congress (Public Law 110-28). This law would require prescribing practitioners to submit all written prescriptions for Medicaid beneficiaries, for any drug, on a tamper-resistant prescription pad beginning October 1, 2007. HHSC recognizes and acknowledges the complexity and burden on the Medicaid provider community in implementing this requirement.

HHSC is working with CMS to define the process for implementing this law and will provide further guidance as soon as it is available. In the interim, providers should continue with regular prescribing practices.
